Every day new allegations of corporate misconduct are being reported in the news. As a result the public has become increasingly aware that the Department of Justice and State Attorneys General are clearly focused on the prosecution of business entities and executives. White collar crime has emerged as a top law enforcement priority in many jurisdictions. Oftentimes commercial cases containing allegations of fraud and deception catch the eye of a prosecutor, leading to further inquiry. Additionally, business litigation often involves questions concerning the destruction of evidence, the truthfulness of sworn testimony, and the implications of a civil party's accusations and admissions in criminal matters.
