Selected Results*
Medicis Pharmaceutical Corporation v. Upsher-Smith Laboratories, et al., No. CV05-3458 (D. Az. filed October 27, 2005). Represented Upsher-Smith in a case in which the Court denied a request to enjoin the client from making and selling its products, following a trial to the Court on the issues of infringement, validity and enforceability of the plaintiff's patent. A sealed memorandum decision was filed by the Court on April 25, 2006. The case was stayed on October 19, 2006 pending a re-examination of the plaintiff's patent.
TVI v. Microsoft (N.D. Calif). Represented TVI, the owner of several patents covering the Autoplay feature of Windows. TVI sued Microsoft in the Northern District of California alleging that all versions of Microsoft Windows since Windows 95 infringed these patents. The case settled in October 2005 a little more than one week before trial. Microsoft took a license under the patents. All other terms of the settlement are confidential.
