Strategic IP Monetization
Many companies and investors do not fully understand the scope and value of the IP in their portfolio. Our Strategic IP Monetization group helps evaluate intellectual property, identify hidden value, and develop and execute non-litigation strategies to monetize intellectual property. Our Strategic IP Monetization group helps evaluate intellectual property, identify hidden value, and develop and execute non-litigation strategies to monetize intellectual property. We have aggregated a number of lawyers focusing on IP and technology transactions, Ph.D. scientists and financial advisers to leverage our experience in IP to help you.
We can help you recognize real, quantifiable value if you buy, sell, invest in or operate intellectual property-driven businesses and avoid costly and embarrassing mistakes. If you're a buyer, we'll help ensure you don't overpay. If you're a seller, we'll help you identify valuable IP assets that can increase a purchase price. If you are an investor, we can help you understand the strength and valuation of the portfolio company, and if you operate a business we can help you identify previously untapped revenue streams. Always, we can help you better understand the IP portfolio and its real value.
Step 1- Strategic IP Assessment. The first step in any intellectual property monetization effort is to assess the strength and value of the intellectual property in question, including non-core patents and other IP that may never have received serious evaluation by their owner. We do this through our proprietary Strategic IP Assessment. Our extensive experience in handling IP litigation - in the last decade, we have recovered billions of dollars on behalf of our clients - and full complement of Ph.D science advisors and financial analysts make us uniquely situated among law firms and other IP professionals to deliver an actionable, real-world evaluation of an IP portfolio. The Strategic IP Assessment is the same rigorous process that we ourselves use when deciding whether to commit our capital and resources in contingency fee matters.
Step 2 - Strategic Monetization Assessment. The second step in the intellectual property monetization effort is analyzing what strategic alternatives are likely to produce the highest yield at an acceptable risk level. These strategic alternatives may include targeted licensing discussions, a widespread licensing campaign, a sale-and-lease back transaction, a royalty interest sale, a synthetic royalty financing, a sale of the IP assets, a sale of the company, a restructuring that allows the IP assets to be used as collateral or as a financing vehicle, or, in some circumstances, litigation. Our Strategic IP Monetization professionals have significant experience in non-litigation technology and other corporate transactions and will bring their extensive experience, industry knowledge and professional judgment to bear on these and other alternatives and help you make the best possible decision given your particular circumstances.
Step 3 - Strategic Monetization Implementation. Finally, our Strategic IP Monetization group will help you execute your monetization strategy. The attorneys in this group have extensive experience in negotiating friendly and adversarial licenses, and have completed thousands of technology-focused public and private M&A deals, technology-focused venture capital deals and other technology transactions. We also represent buyers and sellers of assets in bankruptcy proceedings and have handled a broad array of other bankruptcy protection motivated arrangements and reorganizations. If litigation is the best strategy, our intellectual property litigation department is nationally recognized as a leader in the field. Regardless of the tactics you employ to monetize your IP assets, we have the experience to get the job done.
Applicability to You. Our Strategic IP Monetization group most frequently works with intellectual property owners, helping to better understand their IP and to identify and realize hidden revenue streams from previously overlooked IP assets, and with venture capital and private equity firms to evaluate the IP assets of a current or potential portfolio company. We can help you avoid overpaying, identify critical latent weaknesses in the target company's IP portfolio, and identify potentially valuable assets that were not previously included in the acquisition or licensing model. If you regularly deal with complex intellectual property assets, we look forward to working with you.
